Rental Terms & Conditions

HOW
MUSICAMERICA'S RENTAL PLAN WORKS:
I. You may rent for as long as you wish. The
instrument may be returned anytime,
outstanding charges paid, and the rental
agreement will be terminated. Title of
ownership remains with MusicAmerica during
the period of rental.
II. You are responsible for your instrument
until it is returned to MusicAmerica. Do not
leave your instrument at your school or any
other place of delivery without the consent
of MusicAmerica or a designated agent such
other than the Royal Academy.
III. Rental fees will accrue up until the
date the instrument was returned.
IV. No rental or LDT (Loss, Damage or Theft)
coverage fees will be pro-rated or refunded.
V. You will receive an invoice just before
the end of the initial rental period. To
renew the rental, send your payment along
with the invoice stub, by the due date
listed on your invoice.
VI. Contracts are not transferable.
PURCHASE
OPTION
While renting you will accrue equity* that
you can use at any time toward the purchase
of any MusicAmerica instrument. If you
decide to buy, all accumulated rental fees
(after the first year) will be applied
toward the instrument you decide to
purchase. As a MusicAmerica renter, 100% of
your rent (after the first year) can be
applied toward the purchase of any
instrument from MusicAmerica, including the
one that you are currently renting. There is
a 30% discount on all instrument purchases
during the first year of rental. If your
rental equity equals the value amount of the
instrument you are renting, MusicAmerica
will give you the instrument for no
additional fees. With our extensive
inventory, experienced staff, and free trial
policy, we'll make sure you find an
instrument you will love.
* Equity and purchase discount amounts are
calculated from the rental fee excluding tax
and insurance. Equity can only be used for
the same class of instrument that is being
rented. Please see our rental contract for
specific details regarding our equity and
insurance policies.
EXCHANGE OPTION
Your rental instrument may be exchanged
anytime throughout the duration of the
rental. If you choose to exchange to a
lower priced instrument, up to 12 months of
previous paid rental fees will be applied to
the price of the replacement instrument,
provided your account is current. Should
you decide to change to a more expensive
instrument, all rental fees shall be applied
towards the purchase of the replacement
instrument, however the difference in rental
fees shall (at the discretion of
MusicAmerica) be due at the time of the
exchange. Should you decide to change to a
Brand New instrument, the balance
must be paid in 9 equal monthly
installments. This applies to band
instruments of student quality.
PAST DUE ACCOUNTS
If your rental fee is past due, a late
charge of $5.00 will be assessed 30 days
after the due date and every thirty days the
account is in arrears. MusicAmerica
reserves the right to charge past due rental
fees (including late fees) to your credit
card using information provided to
MusicAmerica. If your account is 90 days
past due, the full value of the instrument
shall become due, plus liability for all
collection and legal costs incurred.
Returned Checks: A fee of $25.00 will be
assessed for any checks returned to
MusicAmerica due to insufficient funds or
non-payment.
LDT
COVERAGE FOR LOSS, DAMAGE OR THEFT
For purchased coverage, MusicAmerica will
assume full liability of protecting the
rental customer against loss, damage or
theft of the rented instrument under the
following conditions:
I. Loss
through theft or total destruction by fire
or related destructive accident such as auto
accident or water damage due to flood (lost
or misplacement of instrument due to
negligence is not covered by LDT insurance).
Providing that your account is current, the
instrument will be replaced with an
instrument of equal quality, age and
condition, as determined by MusicAmerica.
In losses as a result of theft, the theft
must be reported within a 24 hour period
after discovery of loss, and a copy of the
police report must be presented to
MusicAmerica within 7 days. All charges up
to the date of loss are still due and
payable.
II.
MusicAmerica or its designated agent, is not
responsible for instruments left at schools
for return without first obtaining proper
return authorization and/or instructions
from either MusicAmerica or its designated
agent.
III. Any damage or breakage to the rented
instrument will be repaired to proper
playing condition, without charge, unless
caused by mischievous conduct. Coverage does
not apply to deterioration of appearance
which does not affect the performance of the
instrument, such as scratches, minor dents
and finish blemishes, fading, etc.
IV. Excluded from coverage are: drum
heads, drum sticks, strings, bow re-hairing,
and replacement of expendable accessories
(reeds, mouthpieces, oil, cork grease,
rosin, etc. )
V. Any claims for repair or replacement
shall not alter or diminish the terms of the
rental plan indicated on the fees page or
front of the rental agreement form or online
rental agreement form.
VI. If the
renter defaults on any payment for more than
30 days, LDT coverage will lapse and can be
re-instated only with the consent of
MusicAmerica. No part of this coverage will
be refunded.
VII. All
repairs and replacement of the rented
instruments, under LDT coverage, must be
made by MusicAmerica or its authorized
designated agent. Any repairs by the rentor
or an unauthorized repair agent will void
the LDT coverage and are non-reimbursable.
Please be advised if LDT coverage is
declined, the customer is responsible
and liable for all repairs, damage and loss
by theft or fire of the rented instrument.
